We collect and process various types of personal data when you register and use the Deka Local
Services Website and Deka Local Services App. (hereinafter referred to as the “Neighbourhood
Network”) and to evaluate and optimise use of the Neighbourhood Network. We, Deka Immobilien
Investment GmbH, Lyoner Straße 13, 60528 Frankfurt am Main, have mandated Animus GmbH & Co.
KG, Europaring 60, 40878 Ratingen, to carry out all data processing tasks associated with the
Neighbourhood Network as set out in this Privacy Policy. Animus GmbH & Co. KG carries out these
data processing activities in accordance with statutory provisions and based on a data processing
agreement as set out in Article 28 of the General Data Protection Regulation (GDPR). The following
declaration provides you with an overview of the data we collect from you, in which manner, for which
purpose and on what legal basis this data is processed (e.g. collected, processed, transmitted) and
what your rights are regarding your personal data.
I. Definitions
Where the term “personal data” is used in this declaration, it refers to detailed information about the
personal or material circumstances of a defined or definable natural person, such as your name,
address, telephone number, date of birth, bank details or IP address.
Where the term “controller” is used in this declaration, it refers to Deka Immobilien Investment GmbH
as the person who decides on the purposes and means of data processing.
II. Data processing as part of registration
1. Description and scope of data processing
You must register to use the Neighbourhood Network. The following data is collected and stored when
you register: As a user (resident or employee), your full name, or, as a service provider, your full
company name and the name of the person(s) authorised to represent it, as well as your email
address, your address (billing and, if different, delivery address) and, where appropriate, your
telephone number (e.g. if an appointment needs to be arranged at short notice). You must also
choose a username and password. You can supplement this information with optional details such as
your date of birth.
If you are a resident and are able to access the "Housing File" ("Wohnungsakte") functionality, we will
provide you with documents about your residential unit, e.g. purchase agreements and takeover
documents, provided that we have these documents and are entitled to use them in this way. If you
use services provided by service providers listed on the Neighbourhood Network, we will provide you
with your personal service invoice in the "Invoices" ("Rechnungen") section, provided that we have
these documents and are entitled to use them in this way.
2. Purpose of data processing
We use the personal data you provide when registering as a user to ensure that we, the service
providers and Animus GmbH & Co. KG can contact you about your enquiries and orders by email and
telephone and to pre-fill your address in forms within the application.
We use the personal data you provide when registering as a service provider to present the services
you offer and forward user enquiries directly to you.
3. Legal basis for data processing
We process data based on the initiation and execution of a user relationship between you and us
regarding the provision of use of the Neighbourhood Network, i.e. in order to provide you with the
Neighbourhood Network's corresponding functions and services (Article 6 (1) b) GDPR).
4. Data storage period
Your personal data will be deleted as soon as it is no longer required to achieve the purpose for which
it was collected. This applies if your registration on our Neighbourhood Network is cancelled or
modified, i.e. if the user relationship between you and us in relation to the Neighbourhood Network
comes to an end.
5. Objection and elimination options
You have the option to delete your registration or modify the data stored about you at any time.
III. Data processing as part of the use of the Neighbourhood Network
1. Description and scope of data processing
When you use our Neighbourhood Network, we collect and store the content and other information
you provide. This includes created or shared content as well as messages sent and communications
with other users. This may be information about the content you have posted or the content contained
therein.
2. Purpose of data processing
We use data about the usage of our Neighbourhood Network to provide the Neighbourhood Network's
respective functions (e.g. sharing content, communicating with users).
3. Legal basis for data processing
Where data processing serves to provide the Neighbourhood Network’s respective functions, its legal
basis is the execution of the user agreement (Article 6 (1) b) GDPR).
4. Data storage period
Your personal data will be deleted as soon as it is no longer required to achieve the purpose for which
it was collected. This applies if your Neighbourhood Network user profile is deleted.
5. Objection and elimination options
You have the option to delete your user profile or modify the data stored about you at any time.
IV. Usage analysis
1. Usage data
We collect the following usage data when you visit our website:

IP address of end device – however, this is only stored and used in abbreviated form.

2. Purposes of use
We use usage data for the following purposes:

to improve our products and services. For example, we can identify which functions and
content are particularly in demand and expand and broaden these accordingly. We can see
which end devices are being used and make corresponding technical adjustments to the
Neighbourhood Network. We can identify the countries and regions our users come from and
expand the range of languages on offer accordingly.
•
to identify and rectify errors. For example, we can identify whether the registration process or
other processes regularly fail and on which types of device this happens.
We do not use usage data to identify individual visitors or users or create usage profiles for individual
users.
3. Processing
We do not use cookies for usage analysis. We only process information that is transmitted to our
servers from your browser by default. This means your IP address is only stored in an abbreviated and
anonymised form. We operate our usage analysis software (Matomo) on our servers. We do not use
any third-party providers or cloud services. We delete usage data after 24 months. The legal basis for
this processing is our legitimate interest in analysing the use of our website in order to improve our
products and services, identify and rectify errors, and provide statistical evaluations, Article 6 (1) f)
GDPR.

VI. Transferring data to third parties
The Neighbourhood Network is made available to us as a browser-based online platform by our
service provider Animus GmbH & Co. KG, Europaring 60, 40878 Ratingen.
Animus GmbH & Co. KG operates this platform on servers at the data centre it uses from Amazon
Web Services EMEA SARL, 5 RUE PLAETIS, L-2338 Luxembourg.
Amazon Web Services EMEA SARL processes data exclusively within the territory of the Federal
Republic of Germany, a member state of the European Union or in another signatory state to the
Agreement on the European Economic Area. The server used by Animus GmbH & Co. KG at the data
centre of subcontractor Amazon Web Services is located in Germany. Hetzner Online GmbH and
Amazon Web Services EMEA SARL
act as processors for Animus GmbH & Co. KG in accordance with Article 28 GDPR.
Animus GmbH & Co. KG has subcontracted 1&1 Internet SE, Elgendorfer Str. 57, 56410 Montabaur to
process data from incoming emails within the Neighbourhood Network. 1&1 Internet SE acts as
processor for Animus GmbH & Co. KG in accordance with Article 28 GDPR.
Animus GmbH & Co. KG has subcontracted rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg im
Breisgau to process data from outgoing emails within the Neighbourhood Network. rapidmail GmbH
acts as processor for Animus GmbH & Co. KG in accordance with Article 28 GDPR.
We have subcontracted Pusher Ltd., 160 Old Street, London EC1V 9BW, United Kingdom, to process
data associated with the sending of push notifications to your mobile device in connection with the use
of the Neighbourhood Network. The EU Commission has ruled that the United Kingdom offers an
appropriate level of protection as defined by Article 45 (2) GDPR. Pusher Ltd. can engage
subcontractors in the USA for which the EU Commission has not ascertained an appropriate level of
protection. Pusher Ltd. will then ensure that the subcontractor reaches this level of protection by
concluding standard contractual clauses with them. These standard contractual clauses can be found
at https://eur-lex.europa.eu/legal-content/DE/TXT/HTML/?uri=CELEX:32010D0087 (Appendix).
Data is transmitted to Animus GmbH & Co. KG and, if services are procured, to the service providers
specifically listed in the Neighbourhood Networkfor the purpose of using the services offered on the
Neighbourhood Network (e.g. providing services, exchanging information with other Neighbourhood
Network users, etc.) as well as for the following purposes:

so that we, the service providers or Animus GmbH & Co. KG can contact you about your
enquiries and orders by email, telephone or post and if necessary in the case of service
providers, simplify things for you by using pre-filled contact or registration forms;

so that the service providers you have appointed can identify you and provide the services you
have ordered;
•
so that you can report any defects at the property to us; and
•
so that you can agree appointments with our relevant contact person or the service provider.
If you have not chosen not to be visible, your fellow residents/colleagues will see you with your name
and, if applicable, your address.
If you are the owner or tenant of the property and are able to access the "Housing File"
("Wohnungsakte") functionality, we will provide you with documents about your residential unit, e.g.
purchase agreements and takeover documents, provided that we have these documents and are
entitled to use them in this way. If you use services provided by service providers listed on the
Neighbourhood Network, we will provide you with your personal service invoice in the "Invoices"
("Rechnungen") section, provided that we have these documents and are entitled to use them in this
way.
VII. System authorisations on native mobile apps
If you have installed our native app on your mobile device (e.g. via the Apple App Store or Google
Play Store), our app requires certain authorisations. The following explains which authorisations we
need when and for which purposes:

All required fields are marked on our website with an asterisk (“*”). It is not possible to use the
corresponding function without providing this information.
We can use technical service providers acting under instruction for the technical operation of the
website.
Data is only transmitted to countries outside the European Economic Area where this is clearly
indicated.
We measure the storage period for your data based on the specific purposes for which we are using
the data in question. In addition, we are subject to statutory safekeeping and documentation
requirements arising from the German Commercial Code (HGB) and German Fiscal Code (AO) in
particular. Finally, the storage period is also assessed in accordance with statutory limitation periods,
which generally amount to three years under legislation such as Sections 195 et seq. of the German
Civil Code (BGB).
